01About these terms

These terms and conditions ("Terms") apply to your use of tocheetech.com (the "website"), operated by TocheeTech Inc. ("TocheeTech", "we", "us"), a corporation registered in Ontario, Canada, with its office in Toronto.

By using the website, you agree to these Terms. If you do not agree, please do not use the website.

02Using the website

You may use the website for lawful purposes, to learn about our services and to contact us. You agree not to:

• Break any law or anyone’s rights while using the website.
• Try to gain unauthorized access to the website, its servers or connected systems, or interfere with how they work.
• Upload or send viruses, malware or any harmful code.
• Use automated tools to copy large parts of the website or to send spam through our forms.
• Pretend to be someone else or give false information in our forms.

03Information, quotes and services

The content on this website is general information about our company and services. It is not an offer, and it is not professional, legal or financial advice.

Any estimate, proposal or quote we send is not binding until both parties sign a written agreement. All services we provide are governed by that agreement, including scope, fees, timelines, payment terms, intellectual property and confidentiality. If anything in these Terms conflicts with a signed agreement, the signed agreement prevails.

04Intellectual property

The website and its content, including text, design, graphics, icons, illustrations, code and the TocheeTech name and logo, belong to TocheeTech Inc. or its licensors and are protected by Canadian and international intellectual property laws. You may view and share pages for personal or internal business use, but you may not copy, modify, republish or sell our content without our written permission.

05Client names and case studies

Client names, logos, trademarks and website screenshots shown in our case studies belong to their respective owners. We show them only to describe work that was performed, and their use does not mean the owner endorses us.

Projects labelled "Group project" were delivered with one of our sister companies: TechyWe, our engineering partner, or Socias. Each case study names the company it was delivered with. Results described in case studies are specific to those projects and are not a promise of similar results for any other project.

If you own a name or logo shown on the website and would like it removed, write to nicolas@tocheetech.com and we will act promptly.

06What you send us

When you contact us, please make sure the information you send is accurate and that you have the right to share it. Please do not send confidential or sensitive information until we have agreed on how it will be protected, for example through a confidentiality agreement. Our Privacy policy explains how we handle personal information.

07Links to other websites

The website links to other websites, including the live sites of our clients. We do not control those websites and are not responsible for their content, availability or privacy practices. Visiting them is at your own discretion.

08Disclaimer

We work to keep the website accurate, secure and available, but it is provided "as is" and "as available". To the extent permitted by law, we do not guarantee that the website will be uninterrupted, error free or free of harmful components, or that all information is complete and current.

09Limitation of liability

To the fullest extent permitted by law, TocheeTech Inc., its directors, employees and partners will not be liable for any indirect, incidental, special or consequential damages, or for loss of profits, data or business, arising from your use of, or inability to use, the website.

Nothing in these Terms limits or excludes any right or remedy that cannot be limited or excluded by law, including your rights as a consumer under Ontario’s Consumer Protection Act, 2002, where it applies.

10Indemnity

If you use the website in breach of these Terms or the law, you agree to cover the reasonable losses and costs, including legal fees, that we incur because of it, to the extent permitted by law.

11Accessibility

We are committed to making the website accessible to everyone, in line with the Accessibility for Ontarians with Disabilities Act (AODA) and the Web Content Accessibility Guidelines (WCAG). 12Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. You agree that the courts of Ontario, sitting in Toronto, have jurisdiction over any dispute about the website or these Terms, except where the law gives you the right to bring a claim elsewhere.

13General

If any part of these Terms is found invalid or unenforceable, the rest remains in effect. If we do not enforce a right immediately, we do not give it up. We may update these Terms from time to time; the new version applies from the date posted here, so please check back occasionally.
