Your privacy matters to us. This policy explains, in plain language, what personal information we collect through this website and our services, why we collect it, how we protect it and the rights you have.
01Who we are
TocheeTech Inc. ("TocheeTech", "we", "us") is a corporation registered in Ontario, Canada, based in Toronto. We design and build websites, software and digital marketing for businesses.
We are responsible for the personal information we collect and hold, and we follow the Personal Information Protection and Electronic Documents Act (PIPEDA), the federal law that governs how private sector organizations in Ontario handle personal information. We have named a Privacy Officer who is accountable for this policy (see Contact us).
02Information we collect
We only collect what we need. That includes:
- Information you give us. When you use our contact form or email us: your name, company, email, phone number, the service you are interested in, your budget range and your message.
- Client information. If you become a client: contact details of your team, billing information and the project information you share with us.
- Technical information. Like almost every website, our hosting provider automatically records basic technical data when you visit, such as your IP address, browser type, the pages requested and the date and time. We use it only to keep the website secure and working.
We do not collect sensitive information such as health or financial account details through this website, and we ask that you do not send it to us through the form.
03How we use your information
We use your personal information only for the purposes we explain here, or for purposes a reasonable person would expect:
- To reply to your enquiry and prepare a proposal or quote.
- To deliver, manage and invoice the services you hire us for.
- To send you information you have asked for, and, with your consent, occasional updates about our services.
- To protect our website against fraud, spam and security threats.
- To meet our legal, tax and accounting obligations.
We will not use your information for a new purpose without first asking for your consent, unless the law allows or requires it.
04Consent
By sending us your information through the form or by email, you consent to us using it to respond to you as described in this policy. Where information is more sensitive, or where a use would not be expected, we will ask for your express consent.
You can withdraw your consent at any time, subject to legal or contractual limits, by writing to nicolas@tocheetech.com. We will explain what withdrawing means for you, for example that we may no longer be able to provide a service.
07Storage outside Canada
Some of our service providers store or process information outside Canada, including in the United States and, for projects delivered with our engineering partner, in Latin America. While it is there, your information may be accessible to courts, law enforcement and national security authorities of those countries under their laws. We protect it with the same care wherever it is processed.
08Commercial emails
We follow Canada’s Anti-Spam Legislation (CASL). We only send commercial emails when we have your express or implied consent, every message identifies us and includes a working way to unsubscribe, and we process unsubscribe requests within 10 business days.
09How long we keep it
We keep personal information only as long as we need it for the purposes above:
- Enquiries that do not lead to a project are deleted within 24 months.
- Client records are kept for the length of the relationship, and afterwards as long as required by law. For example, the Canada Revenue Agency generally requires business records to be kept for six years.
When we no longer need information, we delete it or make it anonymous.
10How we protect it
We use safeguards that match the sensitivity of the information, including encrypted connections (HTTPS) on this website, access limited to people who need it, strong passwords and multi-factor authentication on our tools.
No system is perfectly secure. If a breach of security safeguards involving your information creates a real risk of significant harm, we will notify you and the Office of the Privacy Commissioner of Canada as soon as feasible, as PIPEDA requires, and keep a record of the breach.
11Your rights
You have the right to:
- Access the personal information we hold about you and know how it has been used and shared.
- Correct information that is inaccurate or incomplete.
- Withdraw consent and ask us to stop sending you emails.
- Complain about how we handle your information.
To make a request, write to nicolas@tocheetech.com. We may ask you to confirm your identity. We will respond within 30 days, and requests are free of charge in most cases. If we cannot give you access to some information, we will explain why, unless the law prevents us.
If you are not satisfied with our answer, you can contact the Office of the Privacy Commissioner of Canada.
If you live in Quebec, you also have the rights provided by Quebec’s Act respecting the protection of personal information in the private sector, and you may contact the Commission d’accès à l’information du Québec.
12Data we handle for clients
When we build or maintain a website or system for a client, we may process personal information about that client’s own customers on the client’s behalf. In that case the client decides how that information is used, and our written agreement with the client governs how we handle it. Questions about that information should go to the client first.
13Children
Our website and services are meant for businesses and are not directed to children. We do not knowingly collect personal information from anyone under 16. If you believe a child has sent us information, contact us and we will delete it.
14Changes to this policy
We may update this policy as our business or the law changes. We will post the new version here with a new "last updated" date, and if a change is significant, we will take reasonable steps to let you know.
